     All items sold on this site must be used in accordance with manufacturer’s instructions, including compliance with any inspection schedules and expiration dates. Buyer assumes responsibility for the proper use of all items purchased.  Please note that when using Avon Protection Systems respirators, filters, and accessories, the use of replacement parts or components other than those supplied by Avon Protection Systems may void NIOSH approval. 

     All customers must read and familiarize themselves with the following:

The sale, transfer, transportation, or shipment outside of the U.S. of any product prohibited or restricted for export without complying with U.S. export control laws and regulations, including proper export licensing, documentation or authorization, is strictly prohibited and may result in civil penalties and/or constitute a federal crime. AGT Tactical will not engage in any transaction that requires the illegal export of any products and will not assist directly or indirectly with the illegal export or re-export of any products. All items on this website are subject to the International Traffic in Arms Regulations (ITAR), and export is strictly prohibited without authorization or a license issued by the U.S. Department of State's Directorate of Defense Trade Controls. By proceeding with a transaction to purchase any item(s), the Customer certifies that (i) the Customer does not intend to export such items without the appropriate U.S. Government export authorization; (ii) the Customer does not intend to export, transfer, sell, or furnish the item to any foreign person, whether abroad or in the U.S., including any Foreign Embassy in the U.S., without the appropriate U.S. Government export authorization; (iii) the Customer understands that a foreign person under the ITAR § 120.16 means "any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3)," and can mean "any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions)" (See ITAR § 120.16); (iv) the Customer is a U.S. Person as defined by ITAR § 120.15, meaning the Customer is a lawful permanent resident of the U.S., as defined by 8 U.S.C. § 1101(a)(20), or is a protected individual as defined by 8 U.S.C. § 1324b(a)(3), or is a "corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the U.S., or is a governmental (federal, state, or local) entity" (See ITAR § 120.15).

     Additionally, items on this website are subject to the Export Administration Regulations (EAR), and export may be restricted by the U.S. Department of Commerce's Bureau of Industry and Security. By proceeding with a transaction to purchase any restricted item(s), the Customer certifies that (i) the purchase does not require AGT Tactical to export such items; (ii) the Customer does not intend to export such items after receipt from AGT Tactical without the appropriate U.S. Government export authorization.

     By proceeding with a transaction to purchase any item from AGT Tactical, the Customer certifies that it will comply with all requirements imposed by all applicable laws, regulations and administrative policies.  Any suspicion that an individual is attempted to purchase a regulated item for a foreign national will be reported to the agencies below.      ITAR Regulations: By making any purchase, the customer acknowledges they will adhere to all ITAR regulations and will not export any item sold on this site.  Please see the “Legal Notice” section for more information. Cases of fraud or illegal activity, such as ordering high capacity magazines to locations where they are prohibited, or requests to ship ITAR items out of the US, will be reported to the authorities. AGT Tactical and its subsidiaries reserve the right to refuse service, terminate accounts, and/or cancel orders (including Purchase Orders) at its discretion without limitation. 

     Payments: With the exception of government, military and law enforcement agencies, all orders must come from a verified Paypal account with a confirmed address. This requirement helps keep our prices low for our customers by preventing fraud.  Please contact Paypal if you are not sure if your account is verified and confirmed. We ACCEPT CREDIT CARD PAYMENTS DONE THROUGH PAYPAL, and our website is secured by both Paypal and GoDaddy systems, and includes SSL encryption. You may purchase merchandise by using any one of the payment options listed.  AGT Tactical reserves the right to change its payment procedures at any time without prior notice.

     NOTE: TOTAL MINIMUM ORDER OF $150 for the sum of items purchased. We are a wholesaler, not a retailer, and require this minimum because it helps keeps our product costs lower for our customers. As a wholesale operation, our margins are small, and we actually lose money on sales less than $150. As long as the items in your cart add up to at least $150, you are good to go. Orders which do not meet this requirement will be refused and refunded without notification, minus associated Paypal fees and a $10 service fee.    

          Shipping & Delivery: We ship merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, and the US Virgin Islands.  We can not ship to APO, FPOs or any other country, including Canada and Mexico.  WE CAN NOT SHIP ANY ITEM OUTSIDE THE US because most of our products are ITAR Restricted.  See “Legal Notice” section for more information.  If we have the item in stock, it will ship within 5 business days.  But please note that some items may be shipped from the factory in order to provide you with the newest possible manufacture date.  In such cases, we are dependent on the manufacturer for delivery times, with 3 weeks being typical (sometimes shipments may take 4-6 weeks due to surges in demand caused by holidays, world events, or government mass orders).  We try to keep items in stock, but we also do not want t to sell you a filter that has been sitting in a warehouse for years, as some other retailers have been known to do.  Waiting will often provide you with the newest and most up to date item available, as you will get the item as new as we do from our manufacturer.  Shipping & Handling fees include any associated PayPal or Credit Card fees (you will not be billed separately for these costs).  These fees are usually about 3% of the purchase price.  Paypal sets these rates, and customers benefit from the added security Paypal provides for all transactions.  We offer Priority Mail shipping, but we can at our discretion use other services from USPS or UPS.  The shipping shown on your order is what we are charging for shipping, as the actual rate we are charged may be more or less than the rough calculation the Paypal shipping calculator makes.  Our customers will never pay more than this.  The risk of loss for all merchandise ordered passes to the customer when the merchandise is delivered to the shipping carrier, though we have never had any loss.  Items returned to us because the customer's address was incorrect or the customer was not available to receive the item will be reshipped for an additional reshipping fee (shipper will make at least 3 delivery attempts, and will leave notice each time). 

     Return Policy: For the safety of our customers, we cannot accept returns on respirator, health, hygiene, food, or hydration products, including all Avon Protection Products.  Please be sure you want what you order.  This policy helps us provide our customers with the lowest prices possible.  To date, we have received zero refund requests because our customers are always so pleased with their order when it arrives!

    Cancelled Orders:  Cancelled orders for any reason will be subject to a 15% service fee (with a minimum of $25.00), plus the cost of shipping and Paypal fees (these on not refundable).  This is done to reduce the cost to our customers, as many products are custom ordered for the customer once an order is received, and we have to pay a 10% fee for cancelling ourselves.  We have only had one cancelled order in 5 years, as our customers are very knowledgeable and generally know what they want when they order. 

     As a wholesaler, AGT Tactical does not warranty any item.  Warranties, if available, are the exclusive responsibility of the manufacturer of the item purchased.  Consumers/purchasers are responsible for handling any and all warranty issues by going directly to the manufacturer.  AGT Tactical is not responsible for any warranty issue or failure of a manufacturer to adhere to its warranty promises.  Please contact the manufacturer if you have any warranty questions.
